1. Introduction

Welcome to FlipsAura ("Company," "we," "our," "us"). These Terms of Service ("Terms") govern your use of our website located at [flipsaura.com] (the "Site") and any related services provided by FlipsAura (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms, including our Privacy Policy and any other policies referenced herein.

FlipsAura is an online marketplace that connects customers with wedding service providers ("Vendors"), including venues, planners, decorators, photographers, caterers, and other wedding-related services. We facilitate bookings and payments through our platform but do not directly provide the services offered by Vendors.

2. Eligibility

By using our Services, you represent and warrant that:

  • You are at least 18 years of age and have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872[reference:2].
  • You will provide accurate, current, and complete information during registration and booking processes.
  • You will maintain the security of your account and accept responsibility for all activities that occur under your account.

3. Marketplace Platform

Important Disclaimer: FlipsAura acts solely as an intermediary platform connecting customers with independent Vendors. We do not own, operate, or directly provide any of the services listed on our platform. The contract for services is directly between you and the Vendor. FlipsAura is not a party to any transaction between customers and Vendors, except for facilitating payment processing through our integrated payment gateway (Razorpay).

4. Bookings and Payments

When you make a booking through FlipsAura:

  • You agree to pay the amount displayed at checkout, including any applicable taxes and service fees.
  • Payments are processed securely through Razorpay, a PCI-DSS compliant payment gateway.
  • Upon confirming your booking, you will receive a booking confirmation via email containing your booking ID, vendor details, and transaction summary.
  • Advance payments or deposits collected at the time of booking are held in accordance with our Refund and Cancellation Policy.

5. User Responsibilities

You agree to:

  • Provide accurate and complete information when making bookings.
  • Review Vendor profiles, portfolios, and reviews before making a booking decision.
  • Communicate directly with Vendors regarding specific service requirements, schedules, and customizations.
  • Notify FlipsAura and the Vendor immediately of any issues with the booking or services provided.

6. Vendor Responsibilities

Vendors who list their services on FlipsAura agree to:

  • Provide accurate and complete information about their services, pricing, and availability.
  • Deliver services as described and agreed upon with customers.
  • Respond promptly to customer inquiries and booking requests.
  • Comply with all applicable laws, regulations, and industry standards.
  • Maintain appropriate licenses, permits, and insurance as required by law for their services.

7. Cancellations and Refunds

Cancellations and refunds are governed by our Refund and Cancellation Policy, which is incorporated into these Terms by reference. Please review our Refund and Cancellation Policy for detailed information on refund timelines and cancellation procedures. Refunds will be processed within 5–7 business days after approval[reference:3].

If services are not delivered due to Vendor default, FlipsAura reserves the right to process full refunds to affected customers. In cases of customer-initiated cancellations, standard cancellation charges as specified in the Refund and Cancellation Policy may apply.

8. Prohibited Activities

You agree not to:

  • Use our Services for any unlawful purpose or in violation of any applicable laws (including the Information Technology Act, 2000 and the Prevention of Money Laundering Act, 2002)[reference:4].
  • Circumvent, disable, or interfere with security-related features of our Services.
  • Transmit any viruses, malware, or other harmful code.
  • Impersonate another person or entity.
  • Harass, abuse, harm, or discriminate against any person.

9. Intellectual Property

All content on our Site, including text, graphics, logos, images, and software, is the property of FlipsAura or its content suppliers and is protected by Indian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

10. Limitation of Liability

To the maximum extent permitted by law, FlipsAura shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
  • Any loss or damage incurred as a result of interactions with Vendors, including but not limited to service quality, timeliness, or safety.
  • Any delay or failure to perform resulting from causes outside our reasonable control.

FlipsAura acts solely as a platform and shall not be held responsible for any loss, damage, or injury arising from services provided by Vendors. Our total liability to you shall not exceed the amount you paid for the specific booking giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless FlipsAura and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses arising from:

  • Your use of our Services.
  • Your violation of these Terms.
  • Your violation of any rights of another party.
  • Any disputes between you and a Vendor.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra[reference:5].

13. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms and/or by sending an email to the address associated with your account. Your continued use of our Services after such modifications constitutes your acceptance of the revised Terms.
